Tidewater II Garden Condominium Association

The Tidewater II Condominium Association, your condo association is comprised of 168 units contained in 13 buildings. The Association is responsible for the buildings you live in, the space immediately around the buildings, the parking lots, and other areas in front of the buildings. This is what your monthly condo fees go to support.

POOL: Every April, Victory Management mails to each residential household an application form for pool passes. Each household is entitled to a season pass for each permanent resident in the household, up to a maximum of six. " Singles" are entitled to two passes. Additional season-guest passes and day-guest passes may be purchased. Only persons with passes are permitted in the pool area. Access to the pool is through the side door of the clubhouse, using a keycard. A certified Life Guard is on duty during pool hours. The pool is open Memorial Day weekend through Labor Day, on the following schedule:
Mon. thru Fri. -12:00 noon until 8:00 p.m.
Sat., Sun. and holidays -11:00 a.m. until 8:00 p.m.
Residents who move into the community during the pool season should contact Victory Management to make application for their passes.
EXERCISE ROOM: The exercise room is in the clubhouse and contains a wide range of weight and aerobic equipment. Access to the exercise room is through the side door of the clubhouse, using a keycard. ONLY community residents may use the exercise room.
KEYCARDS: A keycard, permitting access to the clubhouse for using the Pool and exercise room, may be obtained from Victory Management for the nominal fee of $5.00.
TENNIS COURT: One full size court. ONLY community residents and their guests may use the court. There is a combination lock on the gate. The combination may be obtained by calling Victory Management.
PRIVATE USE OF THE "GREAT ROOM": Any community resident may apply to reserve the "Great Room" in the clubhouse for a private party; Rules governing this use and reservation application may be obtained from Victory Management. The fee is $100.00 to cover the cost of opening/closing and cleaning. A refundable $100.00 deposit is also required.


Tidewater Colony Open Space Association

The Tidewater Colony Open Space Association is an umbrella association which manages the common amenities shared by the members of the three resident associations making up Tidewater Colony. In addition to your condo association (Tidewater II, 168 units), there is a separate association for the townhouses (110 homes) and the garage condos (Tidewater I, 53 units). The Open Space Association controls the amenities such as the pool, clubhouse, exercise room, tennis courts, walking path, tot lots, barbecue pit, and the other open space areas around the perimeter of the community. Any issues concerning these areas are under the purview of the Open Space Association. Of your monthly Home Owners' Association (HOA) fee you pay, $26 goes to support this association. Think of the Open Space Association as the "recreation area" association.

Violations/Hearings/Fines
These and other rules and bylaws are strictly enforced. The first reported violation will trigger a letter from the community's management company pointing out the conduct that is alleged to be a violation and asking that it be corrected. The second reported violation of the same rule will cause a letter to be sent, notifying the owner the Board will hold a hearing at its next regular meeting at which the owner will be given the opportunity to show cause why he or she should not be fined for the recurring violation. At the Board's sole discretion, that second and all future violations can -- and usually are -- met with a fine, typically in the amount of $50.00, which is applied to your homeowner's account, and prompt payment is expected.
Homeowner/landlords are responsible for the conduct of their tenants. Any conduct by a tenant in violation of these and other rules and bylaws will be communicated to the homeowner/landlord, as described above, with copy to the tenant. Any fine imposed for a recurring violation is levied against the property account, for which the homeowner/ landlord is responsible. Accordingly, homeowner/landlords are strongly encouraged to ensure that tenants are aware of the rules and bylaws and abide by them.

These neighbors help monitor the buildings for problems, and notify Victory Management, distribute newsletters, keep Bulletin Boards tidy and up-to-date. They take an active and important part in the community.

Tidewater II Condo Association Committee Structure
The Board of directors adopted the following committee structure, with the mission statement of each committee, at the Board's regular meeting on February 20, 2001:
1. Building and Grounds Committee
Review any problem or proposal referred to it by the Board of Directors relating to repair or maintenance of any aspect of the buildings or grounds of the community, and make a report and recommendation to the Board regarding the need for and scope of any proposed action. Review any proposal referred to it by the Board of Directors that would alter the exterior appearance of the community, and make a report and recommendation to the Board regarding disposition of the proposal. In either instance, monitor progress of Board- approved action and report to the Board as to the satisfactory nature of its completion.
2. Landscape Committee
Monitor the common grounds for conformity, continuity, and aesthetics, and periodically make recommendations to the Board of Directors relating to maintaining and improving the landscaping of the community. Monitor implementation of Board-approved action and report to the Board as to the satisfactory nature of its completion.
3. Budget Committee
On a quarterly basis, report to the Board of Directors on the state of the current budget and recommend any appropriate mid-stream budget modifications. On the basis of the current budget and in coordination with the management company, prepare and present to the Board of Directors, by a certain date set by the Board each year, a proposed budget for the next fiscal year.
4. Social Committee
Periodically organize and conduct social events that will be made available to each resident in the community. Such occasions may include gatherings in the community as well as trips and events outside the community.


PLEASE DO NOT (Continued):
· Do any outside cooking at all (except in grill areas provided in designated picnic areas that contain cooking grills.(Art.X, sect. 3(p))
· Permit any loud or unusual noises in your unit between 11:00pm and 9:00am, or at any time in a manner that disturbs other unit owners (such as excessive dog barking). (Art. X, sect.3(o))
· Store any personal property upon the General Common Elements (that is, beyond your patio/balcony). (Art. X, sect. 3(b): Rule 2)
· Accumulate unreasonable or unsightly litter, etc., within any unit or on any balcony or patio. (Art. X, sect. 3(i))
· Place any trash containers in public view, such as on balconies or patios. (Art. X, sect. 3(i))
· Keep any animals as pets within your unit, except two dogs or two cats and caged domestic birds. (Art. X, sect. 3(e); Rule 13)
· Park any vehicle that does not display current registration plates or any commercial or other prohibited vehicle.(Art X, sect. 3(g) & (r))
· Park any commercial vehicle, which has been designated for or adopted to transport good or persons as its primary purpose, or displays a logo, decal, lettering, symbol, or ornament affixed for purpose of advertising any person, service, product, or which has a net weight of over 6,000 lbs on the Common Elements. Passenger cars, mini-vans, vans and pickup trucks may not have any logo, decal or advertisement appearing on the vehicle.(Art. X sect 3(r))
· Perform any repair or maintenance of motor vehicles, including washing, on community property. (Art. X, sect 3(g))
· Beat or shake any rug, etc., or sweep dust or litter from a balcony onto a lower balcony or patio (Rule 3)
· Throw or empty anything (including cigarette butts or matches) out of windows or over the balconies or patios. (Rule 6)
· Use or dispose of any hazardous or toxic substances, wastes, or motor oil anywhere in the community or bring any combustible or inflammable material into any unit except for normal household products. (Art. X, sect. 3(j); Rule 12)

PLEASE CONSIDER:
· Laying patio carpeting on your balcony. Among other advantages, it protects your neighbors below you from debris, rain and snow falling between the boards of your balcony deck.
· If you are a landlord, make this document part of your lease agreement and post this notice in your rental unit so that all tenants are aware of our community rules and regulations.
· Leaving a key with either your Building Representative or a neighbor. Notify Victory Management of alternative contact information in case an emergency arises.

STANDARDS OF CONDUCT ADDRESSED BY BYLAWS AND RULES (Approved 2/20/2001 – Revised 1/11/2006)

For your convenience, the Board of Directors of Tidewater II Garden Condominium Council of Unit Owners has compiled the following “bullet” summary of certain conduct and actions that are specifically addressed by the Condominium’s bylaws and/or rules. This summary is not intended to be exhaustive; instead, it answers the questions that arise most frequently about what is or is not permitted under the bylaws and rules. We hope that this summary will assist all unit owners and tenants to comport themselves in accordance with the community’s published standards. The Board does have the power to levy fines against Unit Owners for violation of these By-Laws and Rules.

PLEASE DO:
· If a unit owner leases a unit, provide a copy of that lease, prior to its effectiveness, to the Board for its approval. Approval shall be based solely on whether the lease expressly requires the tenant to observe all community rules and bylaws. (Art. X, sect. 1 (b))
· Provide the name and address of your current mortgage holder to the Board, through Victory Management Company. (Art. XVII, sect. 1)
· Leash and control any pet when outside your unit. (Art. X, sect. 3(e); Rule 13)
· Clean up waste from pets when “walking” them and appropriately dispose of such waste. (Rule 14)
· Place all trash in bags & deposit in the dumpster. Do not place any items outside of the dumpsters. Breakdown boxes.(Rule 3 & 11)
· Obey all parking and traffic rules, including no double parking and or parking in fire lanes or other restricted areas. (Rule 8)
· Keep building entry doors locked at all times for security purposes.

PLEASE DO NOT:
· Lease a unit for less than a 12-month period. (Declaration 6A4)
· Hang any item on or over balcony rails, or hang or attach any item at all (including planters, chimes, and flags) to exterior of building or the balcony above. Planters and flag stands are permitted on the floors or patios or balconies and on tables or appropriate stands. (Art. X, sect 3(m); Rule 7)
· Install window treatments that do not have a white backing. (Art. X, sect. 3(n).
· Many any changes at all to the exterior of your unit without prior permission of the Board. (Art. XI, sect. 1(a); Rule 7)

SERVICE CONTRACTS
The following are a few of our service contracts we believe you would be interested in.
Trash Removal:
Trash pickup is 2 times/week; Tues. & Fri a.m. All trash is to be placed inside the dumpsters. Bulk items are not to be deposited at the dumpster locations. The association has to pay anywhere from $20-40 per item for removal. Take items to County facility on Burns Crossing Road. Please report unauthorized use of containers to Victory Mgmt. so the Association can take action.
Janitorial:
Our Janitorial Contract covers the following cleaning services:
Weekly:
1) Vacuum all area halls, stairs and interior walkways.
2) Clean entrance door glass interior and exterior.
3) Remove all cobwebs from interior hallways.
4) Remove all cobwebs at exterior entrance ways.
5) Check all interior and exterior light bulbs and replace as needed.
6) Blow walkways from front door to main sidewalk.
7) Police front of buildings for loose debris.
8) Dust all baseboards, railings and railing baseboards with treated mop or cloth.
9) Clean interior light fixtures.
10) Police trash bins areas and clean as needed.
Services are provided on Thursday and Friday between the Hours of 8:00 a.m. and 4:00 p.m.
The contractor observes the following holidays and will not perform services on these days: New Year's Day, Memorial Day, Independence Day, Thanksgiving and Christmas Day. In the event a holiday falls on Thursday or Friday another day will be substituted that week.
Miscellaneous: Clean all carpeting (hallways/stairs) in all buildings upon notification from the Board.

Landscape:
A brief description of services provided:
1) Mowing once every 7-10 days not to exceed 24 times/year.
2) Edging every other mowing.
3) Fertilization -TURF (early spring, fall & late fall).
4) Crabgrass & Broadleaf Weed Control (spring).
5) Mulching (once in spring).
6) Pruning (trees- 2 times –shrubs & groundcover 3 times).
7) Fall Leaf Removal. (2 times)
8) Weed Control (once every 2 weeks).
9) Seeding & Aeration (between Sep 15-Oct 15).
(One year contract for the 2006)
